When to file bankruptcy

95% of my debt is student loans; however I’ve not been out of school for 10 years. the 10 year date will be Aug. 2008. When do I apply so that debt will be included—in Aug 2008 or 9 months previously so that by the time my duties are complete the Aug 2008 date will be effective. I’ve spoken to a trustee and they said my only way out is to wait and file bankruptcy as my income is too low to do anything else.

The earliest you would want to file would be the first day of the month after the 10 years expires.

So if you last attended school in August 2, 1998 then you should wait until September 1, 2008 to file otherwise you may run into some difficulties.
