Can somebody declare bankruptcy when they have been charged and not yet tried?

There is nothing that prevents someone with criminal charges pending from filing bankrutpcy, but this does not mean that these charges will be cleared by doing so.

Section 178 of the Bankrutpcy and Insolvency Act stipulates certain types of debts that are not released by filing bankrutpcy and includes fines and penalties imposed by court for criminal or quasi-criminal acts.

To determine how the charges in question will be treated you would be best to cotnact a local trustee directly.
