will we lose our house if both of us declare personal bankruptcy
im in nova scotia canada, my husband and i do have debt problems my husband has a debt of about $4.000 solely in his name and i have one for about the same amount solely in my name, but we also have a morgage on our home and we are afraid to do a personal bankruptcy because we dont want to lose our home, we contacted different debt agencies but no one will help us.weve tried every thing we could think of, can you tell me if we would lose our house if either, or both of us declared personal bankruptcy.
thank you

At this point, I don’t see any major value in filing for bankruptcy if your debt is only $10,000 and you have assets that you will loose worth $9000.00. It would probably be best to simply liquidate the RRSP’s and pay off as much of your debt as you can.
As for your husbands advice to not be truthful when filing a bankruptcy, you are correct that he is suggesting you commit fraud and by doing so you will find a bankruptcy will become very difficult
For more information you are best to contact a licensed trustee, but remember their advice will only be as good as the information you provide.
