How to get my name off Morgage….

Hello,
Girlfriend put me on her deed and property, she is in process of coming out of Bankruptcy in two months. She asked me to put my name on the morgage too as I was living there for 5 months and we planned on getting married. She and I had my name put on the morgage which lowered her payments by $250.00 then after a couple of weeks her personality changed like Jeckle & Hyde and now were seperated and I moved out. What do I have to do to get my name off the morgage so that I am not liable and off the deeds so that no creditors can come after me for anything she does. I DO NOT want to declare bankruptcy but it looks like it will start down this road if she continues.

To get your name off title you are going to have to make this request of your local land titles office. However, more importantly is the mortgage. Unfortunately you may find this very difficult, once you have signed mortgage documents the lending institution is not willing to remove one parties name (they prefer when 2 people are listed as responsible for the debt as it is less risky for them). Regardless, you will have to contact the lending institution to make this request. The one bit of advice I have is make sure not to remove your name from title prior to being removed from the mortgage, otherwise you may be left in a position where you are fully responsible for the debt but have no control of the asset in question.
