Hi: Could you tell me if money owed to family maintenance could be wiped out by declaring bankruptcy? I understand taxes are but not sure if family maintenance is. A family member is caught between a rock and a hard place.
The monthly rate is far in excess of his income and any time he works long hours to try to get ahead it is taken. Resulting in him not being able to save enough for a lawyer or even enough to be able to live or visit his kids. I would think that common sense would apply but it seems in this case it does not. A reply at your earliest convienience would be greatly appreciated. Thankyou for your time.

While you are right that tax debt is something that is cleared by bankruptcy in Canada, any debt relating to spousal or child support is not. Now if your family member has additional debts filing consumer proposal or a bankruptcy
may alleviate some pressure and free up funds that can then be directed to paying off the maintenance order, but it will not clear those debts.
