Credit card debt

I seperated from my wife and immediatley called the bank and had her name removed from the credit card account, her name did not show up on any further statements. I declared bankruptcy and listed the credit card as a creditor. Now the bank is going after my ex-wife for the credit card debt. Is the fact that she was no longer listed on the statements and has not been for a long time not enough to end her responsibility for the debt?

There is no magic number as to when creditors will start to garnishee. Each creditor has it’s own internal practices and procedures and even with those guiding principles there is a great deal of discreation given to the individual. so the result it could be a month an a half or it could be 6 months, it is impossible to predict.

As for differing opinions, it sounds as if the majority of the opinions suggest declaring would be advantageous. Without having seen the specific details relating to your assets and liabilities I am not in a position to be able to provide any concrete advice, but my suggestion is this, you may not have much of a choice. What I mean by that is if you are concerned with garnishment you back must be up a wall as the potential garnishment will likely cause you significant difficultes. As a result you probably should consider taking some sort of action (i.e bankruptcy) so that you can prevent your situation from deteriorating futher.
