Adding more $ to what we owe
Now my husband and I have been trying hard to get out of bankruptcy for some time now. We owed $2800.00 (paid) to the bankruptcy company we went through. Then we both had to pay $6500.00 each. We have been paying it monthly as we have a large family. My husband called today to ask if his last payment is this month or next month. He was informed things have changed and we need to do up a new budget and the courts will decide if we owe more money. They state that things have changed. I find this hard to believe as we compied with all the conditions but it has taken us awhile to finish paying this debt. We never recieved anything in the mail stating we have this change. When we claimed bankruptcy everything was on paper as to what we were to do and how much we owed. Can they change what we owe if things have changed after the date we made our claim?

It doesn’t sound like your trustee is doing anything unusual. If circumstances changed during a bankruptcy it is common for the cost to increase. Every trustee in Canada must adhere to a surplus guideline that is set by the Superintendent of Bankruptcy and determines what the cost will be. If your surplus is significant your trustee will be required to notify the court and they will determine if anything additional needs to be done.
