Wifes Ex-Spouse if filing for bankruptcy
My wife was in an abusive relationship with an alcoholic.
She was divorced and the divorce papers say that he was responsible for the debt.
He had a credit card, which she had no access to, and a line of credit, which she had no access to. She recalls signing papers at times during the marriage under duress.
He is now filing for bankruptcy, nearly ten years after the divorce.
We have been married for nine years and lived most of the time in the U.S.
Does my wife have any responsibility for any of the debt?
Thanks,

Unfortunately, if your wife signed the original credit applications then she may very well be a joint debtor or co-borrower on the debts. If she is then she may be legally held responsible for the balance(s) on the account(s).
The divorce order cannot remove your wife’s responsibility to repay the debt (after all, the companies that lent the money were not party to the divorce). She may be able to take her ex back to Court since he didn’t comply with the divorce order – whether or not that makes any sense will depend on whether or not she wants to hire a lawyer and whether or not you think her ex has the money to pay her anyway.
If you reside in the US then your wife doesn’t need to worry too much about any CDN obligations – they will only create a problem for her if she resides or earns income in Canada.
