Income Taxes still owed?
Canadian citizen, became legal resident of US. Filed for bankruptcy in US. Revenue Canada(and several other Canadian creditors) were listed in the paperwork. Bankruptcy was discharged without problems. Several years later moved back to Canada. Revenue Canada has now witheld current income tax refund claiming money was owed(with interest) from prior to bankruptcy. Other creditors have accepted US bankruptcy.
Question, are income taxes eligible to be discharged in bankruptcy, even if bankruptcy was filed in US?

Unfortunately, your US bankruptcy is not legally binding on your Canadian creditors (including CRA).
Currently there are not any international treaties on debt and/or debt collection. By filing in the US you were protected while in the US. Now that you have returned to Canada you are no longer protected and your Canadian creditors have the right to pursue you as they see fit.
If the debt is more than you can handle you may want to use the links at the side of the page to find a Canadian trustee to assist you.
