Trustee Discharge
Can you tell me if I will receive a written
notification when the trustee I dealt with
applies for his own discharge.
Will I receive a report with disbursment of
funds information for my records?
Even though I rec’d my own discharge a year
ago I won’t feel the bankruptcy is truly over
until this happens.
A bankrupt is discharged when they have completed all of their duties. A trustee is discharged when the trustee has completed all of their duties.
For example, the trustee will file at least one tax return during the bankruptcy. The trustee must wait until Revenue Canada has assessed the return before the trustee can apply for their discharge. so in all cases the trustee is not discharged until a period of time after the bankrupt is discharged.
Normally a copy of the Trustee Discharge will be sent to you when it is obtained and it does come with a report of disbursements. A year does seem like a fairly long time, so I would contact your trustee to see if this has been sent.
