I am planning bankruptcy. Can they take my wife’s tax refund if I am the only person declaring bankruptcy? Her refund is large (10,000) and she wishes to buy more RRSP’s

As long as it is not a joint bankruptcy I don’t see any way that the refund will be directly attacked. However, these monies should show up as Income as you do the surplus calculation, so indirectly there may be a slightly higher cost of bankruptcy than originally anticipated.
