Regarding inheritance

I filed for bankruptcy June 1, 2005. I was discharged March 2, 2006. My father died Oct. 25th 2005 and left a house to my sister and I. The estate still has to be settled may not be done until May or June 2006. I haven’t received any monies so far.
How does this effect my past bankruptcy

Sorry to hear of your loss.

Unfortunately, when you received news that your father died and that you had been named as a beneficiary in his will you should have notified your trustee. (If you haven’t done so yet you should do so immediately).

Your rights to your father’s estate vest with your trustee. That means your trustee (on behalf of your creditors) takes your place on the will.

This can become fairly complicated – I suggest you talk to your trustee and to a lawyer in order to work things out. If there is enough money in the will perhaps your debts can be repaid in full and the bankruptcy removed from your record. Your trustee should be able to advise you on whether or not this is possible.
