Moving out of country after declaring

My girlfriend may have to file Bankruptcy. Is there a statutory requirement for her to remain in Canada after filing. If so how long. What ramifications are there if she files – has nothing and then leaves. We will be moving overseas regardless.

There is/are no statutory requirements to stay in Canada after you file an assignment in bankruptcy.

That being said, there are duties that must be performed while you remain an undischarged bankrupt that may be difficult to arrange once you leave the country. For instance, if you file bankruptcy you are required to attend to financial counseling sessions and these sessions must be at least 30 days apart. You’d probably want to wait until you’ve completed both sessions before you leave as it could be expensive to fly back for a 45 minute class. It is of course, up to you.
