Home Equity

I have a conditional discharge based on i pay the equity in my home. What would happen if i sell it ? Do i pay the equity we agreed on with our trustee or will i have to pay the new equity as the market here is climbing rapidley. If i wait for a full discharge is there any thing that hold’s me back on selling the house. The mortgage and tax’s are high and i am having difficulty keeping it up.

It depends on the value of your house, the amount owing on the mortgage, and the province you live in. Click on your province under “Find A Trustee” on the left hand side of this page and you can e-mail a trustee in your province for a complete answer.

If you conditional discharge order lists a specific amount then this is what you would be responsible to pay unless the order is appealed and the court provides a different ruling. For more details I suggest you contact your Trustee.
