Question about monthly payments to trustee

We’ve been told what the calculation is to determine how much a month we will be required to pay our trustee in bankrupcy. (50% of our surplus plus $160 to the trustee). What happens when we don’t have surplus in a given month, do we just pay the $160 or is the negative surplus applied to the $160 therefore reducing the overall payment?

You should ask your trustee. For most trustees, you make a minimum contribution to your estate each month (in your example $160, but some trustees may require more or less), and you pay surplus income in addition to that amount.
