How will creditors react?

I am likely going to declare bankruptcy, my wife is not. We have a couple of minor debts, (credit card, automobile loan) in which she is the main debtor and I am a secondary debtor. We understand that these debts will remain hers, and she has no problem continuing to pay them. I would just like to know if she should expect some type of negative response from the holder of the loan. I expect that the trustee will have to inform that I declared bankruptcy.

The safest approach to these creditors from your wife’s perspective will be to contact them BEFORE you file for bankruptcy and confirm that she is the primary lender and intends to maintain the payments on the debt. She might go so far as to suggest that the creditors remove your name from the debts – although, they aren’t likely to do that.

By contacting them first you wife will reduce the risk of the creditors deciding that they don’t want either of you as a customer and calling in her loan (demand 100% repayment immediately).

A little deffort now can reduce a great deal of drama after you file.
