garnishment

What type of income can a card company garnish? I injured myself working several years a go. I can never return to the workforce. My income is from the canada pension plan.My 2 daughters also receive monthy checks from CPP because of my disablity.Can they garnish my cpp? If I was working I assume they could garnish my wages.How do they determine what amount they will garnish . I have a 700 dollar monthy income. Is the amount you need to live on a factor in determing how much to garnish? I find it hard to live on 700 .I would be in dire straits if they were to take a couple of hundred from me. Is it more important to the court that the creditor gets paid rather than what the debtor needs to live on. thank you .I look forward to having you’re insight on these questions.

From the sounds of it your creditors will not be able to garnishee your income as it comes from pension funds. As for the amount that is allowed, this varies by province, but often the provinces follow a similar formula. For example, in Alberta there are 2 cut-offs, $800 and $2400 respectively. The way the formula works is that creditors can garnishee ½ of everything above $800 and all of anything above $2400, this is done on a monthly basis and the cut-offs are increased by $200 for every child in the household.
