restraining order and trustee advice

I am 70 years old and have 30,000 in credit card debt . I have no money in the bank ,don’t own a home or car and my only possessions are a few pieces of furniture in my apartment . My income is from old age pension and the additional supplement . My creditors have placed my debt into collections. My creditor and the collection agency are aware that a trustee advised me to do nothing that I was in what they called creditor proof.They are very angry that I am doing nothing and was advised to do it. They know contacting me will not change the fact that they can never collect because i simply don’t have the money and have no way of ever getting any. I feel that they are only harassing me and possible stalking me . Why are they so angry that the trustee told me to do nothing . I doubt I am not the only person in Canada to be in these circumstances. Do I have the right to apply for legal aid to acquire a restraining order?

I agree with your trustee’s advice. You are creditor proof, so spending the money to go bankrupt is probably not necessary.

My advice to you is first, make sure all of your money is going into a new bank account(at a bank where you don’t owe any money), and second, when the creditors call, simply say “I am on a pension and can’t afford to pay” and then hang up. Don’t have a discussion with them. They may call you back a few more times, but they won’t keep wasting their time calling you, unless they think they are getting somewhere. By hanging up, a restraining order should not be necessary.
