student loan bankruptcy

Does anyone know if I filed for bankruptcy after the 10 year period, could they take away my home, if it was solely in my husband’s name? What about possessions that my husband aquired before even meeting me?

Equity in a residence is a complicated question and the answer may change depending on what province you are in. While normally a spouses bankruptcy has very little impact on their significant other, when there is substantial equity and you have been in the house of a significant period of time you may have to confront the issue of dower rights. It would be important for you to contact a trustee in your area and discuss this issue with him as he will be able to describe how the provincial exemptions work and any potential issues that you may have to confront.
