if you are married do you both have to claim bankrupcy or can only on person claim

Only one person may claim, but be careful. Many couples “jointly” sign their credit cards and other debts. If a debt is joint it means that both people that signed are responsible to repay the debt. If one files bankrupcty the other person will still be required to make payments.

I suggest that you both attend at a trustees office to discuss how the process works and to make certain there won’t be any surprises for the person that isn’t going to sign.
