I was diagnosed with a very aggresive breast cancer in april and have not been able to work since then.I am a single parent of one child.I get $767.00 a month canada pension dissabilty and $243.00 child tax credit.$142.00 every three months GST.I have no other income.I have about $5000.00 in credit card debt and now have collection agents phoning me.I have looked into decalaring bankruptcy and there is no way that i can afford the payments at the moment.I have no assets, no rrsps,no car,I rent my home and less then $4000.00 in houshold goods in my home.If i do nothing and they take me for a judgement will they be able to seize or garnish my money or bank account?If i decide to claim bankruptcy after they get a judgement will i be able to claim their court legal fees to if they charge me for them?

You are in a difficult situation. However, if you have no assets and no wages, it will be virtually impossible for your creditors to get money from you.

They can take you to court, and they may even win a judgement against you, but with no assets or wages there is nothing for them to get from you. Since bankruptcy is way to protect yourself from your creditors, it is therefore probably not necessary to go bankrupt at this time. If your health improves and you return to work, a bankruptcy may be necessary at that time.
