Garnishees

Does CRA have to inform me that they are going to garnishee my wages or can they do it with out letting me know? Do I not have a right to any documentation?

Most creditors have a very set list of things they must do to garnishee (issue notice of a court date, go to court, obtain judgment etc.) the difficulty is that CRA is not bound by these rules and while it seems unusual the have the ability to garnishee without the same protocol that other creditors have to follow. As a result it is common for CRA to garnishee as much as they want without providing you any additional documentation.

The other problem is that CRA is not bound by any limits to a garnishee, so often people have to seek bankruptcy protection to enable themselves to stop the garnishee and be able to afford to live. If this is something you are going to need I would suggest the quicker you contact a local trustee the better so the garnishee can be stopped prior to your next pay period.
