Surplus income and debt

My husband went bankrupt and had a meeting with the trustees. They explained that his `surplus income` was high and we need to pay $1150. That `surplus` income does not take in account any of MY debt that I still have and therefore we really don`t have enough money to pay that. Do we have any options? or should they be looking at all debts (students loans, car payments, visas?)

If this is your husbands bankrutpcy and not yours then the surplus figure will not take into account your debts. The surplus is based on a guideline that is sent to every trustee in Canada and looks not at expenses but at level of income. As such there isn’t any option, if your husband wants to get out of bankruptcy and be cleared from his debts he has to comply with the surplus income obligations.
