too much surplus

Is it true that if you`re above a certain amount of surplus income that your bankruptcy would be extended past the 9 months? Is there a set certain amount or does it vary with each trustee?

As this is up to the court it is very hard to determine, although most trustee’s will be able to get a feel for what the court typically orders in each jurisdiction based on past history.

The trustee’s is required to inform the court where there is substantial surplus but the final decision is the courts.
