Bankruptcy and jointly owned house
April 9th, 2013 by Questions
Hi,
I am divorced but my wife refuses to attend a settlement conference. I’m deep in debt because of the legal expenses. If I declare bankruptcy, can my creditors recover the money owed to them from the house I jointly own with my ex-wife?

Potentially your creditors could recover the debt from the equity in the house, but it really depends on where the divorce proceedings are at. What I would recommend is that you contact a local trustee like myself and review the specifics of the situation directly. This is really the only way to know for sure what you can expect.
