Joint Bankruptcy -vs- Consumer Proposal?
January 24th, 2014 by Questions
My husband and I hold separate accounts and debts. Do we both have to file a proposal or can just the one who is struggling. I can manage my debt load as well as my share of expenses but he is falling behind and I don’t have extra in my budget to help him

Each spouse is free to do what they think is best, independent of what the other spouse decides to do. So your husband can file a proposal and you can carry-on as you have been doing. Keep in mind, that if your spouse files, you will be held responsible for 100% of any joint debts the two of you have together. Make sure you factor those payments into your budget so you don’t get into trouble yourself.
