Will any Trustee let us file for a joint consumer proposal if we are certain we don’t owe the CRA in 2011?

This is one important criterion because we will be filing our 2009/2010 tax returns soon but the 2011 will need a bit more time to work out.

There are very specific requirements that must be fulfilled for you to be able to file a joint consumer proposal, and these requirements don’t have anything directly to do with what you would owe to CRA in 2011.

The major issue is that for you to be eligible to file a joint consumer proposal is the majority of your creditors must be joint creditors. So that is what most trustee’s will use to determine whether your eligible or not.
