marital home/legal separation

June 22nd, 2009 by Questions

My husband and I separated and have a legal separation document. In the document it states that I have rights/title of marital home and responsibility to mortgage. If he now gets a consumer proposal or goes bankrupt can my home be affected? The deed is still in both our names but the document states he has no claim to the home.

There shouldn’t be much risk as simply providing his trustee a copy of the separation agreement and that should be sufficient to demonstrate that he no longer has any interest in the property. But just to reduce difficulties you may want to contact land titles and see what is involved in getting his name removed from the property completely.
