Joint accounts and a consumer proposal

My question is: If all the debts are joint can one person file for a consumer proposal or does it have to be in both of the names? We would like to avoid having to put my spouse`s name so that one of us has some credit left.

The big problem you will run into is that if one of you files for a consumer proposal this will result in that persons debts being cleared. The party who hasn’t filed the consumer proposal will still be fully responsible for all the debts their name is attached to. So this would include any joint debts.
As a result the proposal may not be of much assistance unless you file it in both names.
