worried
September 26th, 2008 by Questions
I am thinking about filing for bankruptcy, or consumer proposals should I wait 3 months before filing? I am a little scared because I maxed out my credit line and I also used my credit card as well. I just found out from this site that a person can be charged with fraud, is this right?

If you have deliberately increased your debt load in the three months immediately preceeding a bankruptcy (or a proposal) it can get you in a lot of trouble. Beleive it or not, there are folks that, once they decide to file for bankruptcy, figure they may as well max out their credit – this is clearly fraudulent and will complicate your bankruptcy.
If on the other hand, you’ve continued to use your credit cards as you normally have (gas, small purchases, etc) and you stop using them after you speak to a trustee or credit counselor then you’re likely ok.
