Creditor is chasing me after 5 years

After 5 years of consumer proposal … and that went well and paid off for 3 years now, one of the creditor is after me.. How could that happen? What did I do wrong? Or I didn`t do what I was suppose to do? I have never received the proof of completion. But did the creditor receive it anyhow?

I think you should start by confirming with your trustee that the paperwork required to complete your proposal from their end was filed as required. You should also request copies of the final documents so that you have proof should this happen again.

AS far as this creditor is concerned, it should be a simple matter of forwarding copies of the completion documents to their offices – it sounds as if some one some where simply hasn’t recorded the fact that you’ve completed your proposal.

If the creditor is not co-operative then I suggest you send them a letter instructing them to cease collection activity and to take you to Court. In Court you will simply show the judge your completion paperwork and then you may ask the Court to award you your costs of appearing (ie the creditor may have to pay you for showing up…).
