Social Assistance

I am currently out of work and on social assistance (welfare). I have credit card debt that I incurred while I still had a job…am I eligible to apply for bankruptcy even though I am on assistance? (Thank you for you answer).

Yes you may, but don’t be surprised if whatever trustee you see suggest that you may want to wait until you return to work. What you may not know is that social assistance cannot be seized or garnisheed – your creditors don’t have the right to take it from you. Many people on social assistance simply stop making payments on their credit cards and other debts – usually because they don’t have enough cash to make the payments anyway. The debts don’t go away, but since they can’t take your assistance and you need the cash for rent and food, what choice do they have?
