Lose my car?

May 29th, 2013 by Questions

I live in a remote area of Quebec where there are few jobs. I need my car to get to town 20 miles away and hopefully find outside work. If I declare bankruptcy, will my car be seized. It is worth $4000 and is my only personal asset.

In Quebec the rules are very specific. They say that if your vehcile is used for work then you can keep it. But if it isn’t used for work purposes then you cannot. In your situation as you live outside of town there is a good argument it is necessary, but that is for your local trustee to determine. So you are best to contact a local trustee, explain your situaiton and verify how they are going to treat your car. If for whatever reason you cannot keep the vehicle, you may want to consider filing a consumer proposal instead.
