My lawyer is holding my divorce papers I am now filing bankruptcy does he have to give all my files and papers to me ?

Nope – if your trustee requires the papers for some reason then your trustee may demand them and your lawyer will have to produce them, but as soon as your trustee is finished with them they have to be returned to the lawyer.
