It has been about 8 years or so since I was discharged from bankruptcy, and I was wondering, on a credit app, there is the question, “Have you ever claimed bankruptcy”?, Legally, do they have the right to ask, or legally how do you answer this question, I feel like answering , none of your business, check my credit report, and if that is not good enough for you, forget about it. What is the right answer?

If the question asks, “have you ever been bankrupt?” then your answer is always going to be “yes”. The fact that you filed should have fallen off your credit report 6 years after your discharge, but if you fail to disclose the bankruptcy when asked and if something goes wrong in the future the fact that you didn’t answer the question truthfully may be used against you in Court…
