name removal
August 2nd, 2012 by Questions
My ex-husband and I bought a home together. Both names on the mortgage and the deed (title). we separated, and both claimed personal bankrupcy. I had his named removed from the deed (title) of the home by a lawyer ( is this possible without the permission of my mortgage holder?) it is time for me to renew my mortgage and want his name off. Do i need to re-apply for a mortgage on my own or can they just remove him?? I held my mortgage through my bankrupcy and made regular payments. please help me clarify what i need to do.. thank you

This is a question that is better posed to the institution that holds your mortgage but typically you will need to re-qualify on your own. But be sure to discuss this both with your divorce attorney and the institution that holds your mortgage.
