Confused

October 31st, 2011 by Questions

My wife and myself have claimed bankruptcy in May of this year 2011 …I am the only employed spouse….We pay a trustee $400 a month as part of bankruptcy agreement……I now have been diagnosed with terminal illness and my wife is in hospital for over a month now with a blood infection. Is there any thing in the bankruptcy act stating we can get a break from paying the trustee on compassionate grounds……Its been tough financially ……

Unfortunately, there is no compassionate grounds covered in the Bankruptcy and Insolvency Act, but your payment should be directly tied to your income. So if there has been a reduction of income then you payment will be adjusted, but unfortunately there is no mechanism for the cost to be reduced due to difficult living circumstances / changes in health.
