unable to meet condition of discharge, and frequent misinformation
July 13th, 2011 by Questions
I am already in bankruptcy, and have already been told my condition of discharge. My question is : What happens at the end of three years, i have been unable to fill my condition of discharge completely, but am making an effort. I am also wondering what recourse does someone have, when you feel the trustee is giving misinformation all the time. every time i have a question i get so many different answers, then they get upset with me when i question the answer.

It sounds like you should contact the Office of the Superintendent of Bankruptcy and ask them to review your file and your trustee’s contact.
In regards to your Conditional Order of Discharge, you have the right to hire a alwyer to bring a motion to vary the Order. Likley the same Court will hear the motion and then decide if your case warrants a change.
I have to warn you that if your circumstances have remained basically the same the Court won’t look vaery favourably on your motion. The Court will need a reason why you haven’t paid as required.
