Selling after bankruptcy
May 30th, 2011 by Questions
I co-own a house with my mom and she recently filed for bankruptcy and was discharged from it in August but has not received her actual court papers saying that it was done. We are looking to sell our home and move into another in the area, but have been told that we need those papers before she can sell. Is this true? We co-own the house, do we still need her papers?

Call the trustee that handled your mother’s bankruptcy – they will explain the process. Before your mother can sell she needs to know that her trustee has returned any interest in the hosue back to her – if she tries to sell while the trustee is on title things will get “messy”.
