What Can I expect??

April 25th, 2011 by Questions

Hi there I did not get discharged from bankrupcy two and a half years ago. I had some money still owing to the trustee before I could be discharged. Since then I have become common law and had two children. I was too embarassed to tell him and now I am so embarrassed I have let it go so long. I have called to seek an appointment with my trustee. What should I expect in this appointment. Will I be charged??

Finishing a bankruptcy becomes a lot more difficult if you didn’t comply with your duties as originally required. The trustee will likely be willing to assist you to finalize things, but there are a number of things you will have to do. First there will be some type of fee to get the trustee reappointed. This is usually around $2,000 but varies depending on the area you live. Once you have paid this most trustee’s will make an application to court, get reappointed and then you must complete your original duties. This coule include anything from payments to counselling sessions to income and expense statements. Normally you will also have to provide the trustee a copy of your most recent pay stub and copies of your notice of assessments for any tax years inbetween the year of bankruptcy and the current year. Sometimes there are a few additional items, depending on circumstance, but in general terms this is what you can expect.
