inheritance after backrupty

The Facts:
-inherited property from parent after the discharge
-was unaware at the time of the bankruptcy that i would inherit anything
-trustee is now claiming the entire inheritance in a small claims court action

The critical date is the time of passing of your parent, noty the date of your discharge. If your were still an undischarged bankrupt when your parent passed then your trustee is correct – the inheritance belongs to your unsecured creditors, not to you. If your parent died after you were discharged then your trustee has not right to your inheritance.
This is a simple matter of fact – were you still bankrupt when your parent died?
