What do I do if the Trustee does not get themselves discharged even after 10 months of the bankrupts discharge and still collects the post bankruptcy GST cheques/tax refunds etc

Your trustee cannot discharge themselves until all of their duties are complete. The biggest hold-up involves income taxes. Trustees are required to file your tax return for the year in which you file bankruptcy, but CRA (Revenue Canada) only has a small team working on bankruptcy tax returns so they take a VERY long time to be processed.

Once all of the work is done it takes another 3 months for a trustee to be discharged. So if you file in Jan and are discharged in Oct (9 months later), your trustee won’t be discharged for at least another year… that’s also when your trustee gets paid, so beleive me, we close them as fast as we legally can…

If you have concerns you should call your trustee and ask them why they haven’t been discharged yet.
