Money in a Court Settlement

July 19th, 2010 by Questions

I will be going to court to obtain money for property my ex sold that she should not have and for my 1/2 of the sale of our home. If I file for bankruptcy can I continue with the court case and what happens when/if I am awarded any money?

This is difficult to answer without knowing many of the details associated with this specific case. But most likely you would not get to keep the money should you file for bankruptcy. During a bankruptcy there are very few instances where you are able to keep any of the proceeds from court. The most common are pain and suffering or personal injury claims. But due to the complicated legal nature and the unique manner each case of this manner has to be treated you are best to discuss the specifics directly with a licensed trustee.
