CPP disability & Bankruptcy

My husband and I had gone bankrupt in Aug/07 I was discharged in June/o8 He was discharged in Dec/08 as it was his second time. We paid off our Bankruptcy in Aug/08.In Jan/08 my husband had to apply for Cpp disability after 2 & a half years they have just informed us they have excepted his case and he will have retro active pay from May/08 coming to him.What we would like to know will bankruptcy take this money from us or because our depths where owing in the year 2007 and before and we did not know he was going to have to apply or even get his CPP because of his health issues in 2008 untill now .

An argument can be made that the retro benefits from May to Nov should go to your creditors, but that is likely all you could lose. Did you tell your trustee that your spouse had applied for CPP in Jan 08, or did you fail to mention that? It may make a difference how this is all handled.
I suggest you call the trustee that was hanbdling your file and discuss this with them. Better to work things out in advance – rather than have the government decide to simply all the money to your trustee…
