student loan collections

April 13th, 2010 by Questions

I filed for backruptcy 10 years ago which included my student loan from 1998. A collection agency is now calling trying to recover that money, am I still responsible for that loan even after I have been discharged?

You need to contact the trustee that handled your bankruptcy to determine whether or not your student loans were actually discharged. If they weren’t old enough to be discharged when your bankruptcy ended then they may still be collectable. Of course it may just be some sort of computer error – the collection agency bought a block of old student loans froma bank and now they are trying to collect on them.

Call your trustee and ask them where you stand.
