Bankruptcy and Disability

I`m in the 3rd month of bankruptcy and am receiving EI. I just got approved for CPP Disability Fast Track and didn`t realise that the Disability payment will be backdated from the first time I relapsed.

Would I lose all the disability that was owed to me from the past till now?

I don’t think you will lose it to the bankruptcy, BUT you should check with the folks at EI – I suspect they will demand repayment of your EI benefits that cover the same period. Whatever funds are left (if any) will be subject to the surplus income rules in your bankruptcy.

I suggest you go and speak to your trustee – they will have had to deal with this before and they can point you in the right direction.
