After the fact

I have been cleared from my bankruptcy for 2 years now. I recently checked my credit report and it now shows a claim from CMHC for the amount of a mortgage that was included in the bankruptcy. Originally the mortgage was included under the bank which I had the mortgage with. But now it`s showing up under CMHC with `status unknown` and a court of queens bench number. I contacted the trustee I used for my bankruptcy and as far as they`re concerned any claims associated with the bankruptcy should have already been dealt with. Any ideas?

I’ve heard of this before for other folks – it comes down to the inefficiencies at CHMC. When your mortgage company received notice of your bankruptcy that allowed them to collect on your CMHC insurance to recover any money they lost on the sale of your house. It often takes CMHC years to get around to making a claim against you for the amount they paid the mortgage company….
To fix the problem you should be able to send CMHC a copy of your creditor’s package, your Discharge Order, and the Final Statement of Receipts and Disbursements from your bankruptcy (your trustee can provide these if you didn’t keep copies – but expect to pay a fee for them). Once CHMC processes the paperwork the debt should be cleared.
