Is bankruptcy a solution for me?
May 17th, 2008 by Questions
Hi,
I was in a relationship with someone who left Canada – we had a house with both names on the mortgage as well as on one other unsecured debt – my problem is that I can`t find her to ask for the permission to sell the house. My question is – could be bankruptcy a solution to that ? Is there any way to solve this without her – she`s not in Canada anymore.
Thank you

Frankly, the easiest (from your perspective) way to deal with the house is to default on the mortgage and let the bank sell it. Once they have they will pursue both of you for the shortfall independently from each other (ie you can file bankruptcy without her).
Any other process to sell the house will involve legal costs for you as a Court will have to order the sale of the property without her consent.
