Consumer proposal after div 1 proposal

I am currently a year from finishing a five-year division 1 proposal. Part of my debts in the proposal are student loans which will not be cleared fully by the proposal (they were 6.5 years old when i filed the div 1). Is it possible to file a consumer proposal once my div 1 is complete on the remaining student loans? If so, my student loans would at that point be 11.5 years old. Would they then be cleared by the consumer proposal? Thanks for your input.

Call your trustee – you don’t need to file a new proposal. Before your current proposal ends schedule a motion to have your student loans included (since they now pass the 7 year test). Depending on where you live, a lawyer will likely charge you $2,000 to $2,500 to make the motion. Of course, the Court will look at your current income and situation before they decide whether or not to eliminate your student loans… Start by speaking to your trustee before you spend money on the lawyer.
