student loan and a new husband

I have a Student loan federal and provincial that is from before we were married, and that I now cant pay, is my new husband going to loose his house and get his wages garnished. If I file for bankrupcy?

A licensed trustee said...

Unless your new husband co-signed or guaranteed your debts, they cannot be held responsible to repay those debts. The only way your spouse will be involved in your bankruptcy is when your trustee determines your monthly payment should be – these payments are based on family size and total household income.
